Buyer to assume a FORECLOSED water lien of approximately $73,000. County has acknowledged they were aware of the leak but continue to let the water run. This water lien will need to be negotiated with county or the case will need to be taken to court and amount may or may not be reduced/eliminated. Engineering report attached. We are looking for 0 days inspection and have buyer do their due diligence up front.
- It’s a known public issue that affected over 50k meters in this county but that happened after our water bill so that’s not relevant as it wasn’t same time period. I would drop this claim.
- The discovery, when we sued, states that the county knew of leak, failed to turn it off or repair/bill customer, to the tune of 3M gallons of wasted water. The link I have with their responses to our questioning is broken but I asked attorney for a pdf. It clearly shows neglect.
In addition, this water lien was foreclosed so I’m not sure if buyers can just quiet title either if it’s a government entity (attorney question but worthy of pursuit).
